What are nursing home arbitration agreements, and why do I want to avoid one?

A: Many facilities have started including language in their admissions contracts saying that in the event that they neglect your loved one, you can’t sue them in court. This is known as an arbitration agreement. In arbitration, a judge and jury is replaced with an arbitrator. Often, the corporation chooses the arbitrator, pays the arbitrator, and dictates the rules that will be used during the arbitration.
